Terms and Conditions
Matthews Playhouse School Shows

By registering for a Matthews Playhouse school show, you (The Buyer) are agreeing to be bound by these Terms and Conditions, including the privacy policy, all applicable laws, codes and regulations, and agree that you are responsible for compliance with any applicable local laws, codes & regulations.

The buyer agrees to compensate Matthews Playhouse in the amount of the per ticket price times the number of attendees plus 7.25% sales tax.  Payment in the form of a check payable to Matthews Playhouse will be due one week prior to the date of the performance.

This contract will terminate automatically upon the conclusion of the contracted performance and can be cancelled only by mutual written agreement of both parties.  However Matthews Playhouse has the right to cancel the agreement due to failure to make timely payments as noted above.

Buyer also agrees to:

Buyer may request additional tickets at the same price plus sales tax as noted above.  Any additional tickets are subject to availability and any consent to sell additional tickets to the Buyer shall be at the sole discretion of Matthews Playhouse.

Buyer is responsible for the full contract fee regardless of how many individuals actually attend the contracted performance.

Buyer, and it’s attendees, shall arrive for the performance at least twenty (20) minutes prior to the performance time.

There will be no refunds of any monies paid to Matthews Playhouse in the event of cancellation by the Buyer (for any cause, including inclement weather or other unforeseen circumstances).  Matthews Playhouse shall in addition to all other remedies available to them at law, will be entitles to retain any monies paid as liquidated damages.

In the event of cancellation of the performance by Matthews Playhouse, Buyer will be notified by both telephone and written form of said cancellation.  If Matthews Playhouse cancels the performance, the Buyer will be provided with alternate performance date(s) & time(s) and shall, in their sole discretion, issue any refund(s), full or partial.

Interest on any payment not made within thirty (30) days of the due date, will accrue at the rate of one and one-half percent (1 1/2%) per month.

In the event that Matthews Playhouse, it’s agents, servants, principals or employees needs to pursue legal action to collect sums due and owing, Buyer agrees to pay all court costs, filing fees, collection service fees and an attorney’s fee of fifteen percent (15%) of the amount awarded to Matthews Playhouse.

In the event that any checks or payments are dishonored by any bank or returned to Matthews Playhouse, Buyer agrees to pay the greater of $25.00 or the bank fees charged to Matthews Playhouse by the involved financial institutions.

Both parties agree that venue for any disputes under this contract shall be within the courts of Mecklenburg County, North Carolina.

This contract shall be governed by the laws of the State of North Carolina.

The Buyer has had the opportunity to review this document and understands it’s terms and freely and willfully agrees to these terms.  This contract supersedes any prior written or oral agreement between the parties.

This agreement embodies the entire agreement between the parties and there are no written or oral understandings and agreements that are directly or indirectly connected with this contract.

There are no warranties, representations, or promises made between the parties other than those expressly noted in this Agreement.
